TERMS OF SERVICE

Effective date: September 8, 2026
Last updated: September 8, 2026

These Terms of Service (“Terms”) govern your access to and use of this website, its content, products, programs, communities, workshops, events, and related services.

This website and its offerings are owned and operated by Alpha with Tracy Lynn Gray LLC (“Company,” “we,” “us,” or “our”), which operates brands including Alpha with Tracy Lynn Gray™, The Anxious Alpha™, and The ADHD Alpha™.

By accessing this website, submitting a form, creating an account, purchasing an offering, participating in an experience, or using our content, you agree to these Terms.

If you do not agree with these Terms, please do not use the website or purchase or participate in our offerings.

1. PURPOSE OF OUR CONTENT AND OFFERINGS

We provide educational resources, self-leadership tools, personal-development programs, digital products, workshops, speaking presentations, communities, and related content.

Our offerings may address subjects including anxiety, ADHD, executive dysfunction, overwhelm, emotional regulation, boundaries, intrusive thoughts, productivity, confidence, courage, and personal growth.

Our content is intended to educate, encourage, and provide practical tools. It is not intended to diagnose, treat, cure, or prevent any medical or mental health condition.

2. NOT MEDICAL OR MENTAL HEALTH CARE

We do not provide medical care, mental health treatment, psychotherapy, diagnosis, crisis intervention, or other clinical services.

Tracy Lynn Gray is not acting as your physician, therapist, psychologist, psychiatrist, counselor, or other licensed healthcare provider.

Nothing on this website or within our emails, downloads, programs, workshops, communities, videos, audio recordings, presentations, or other materials should be considered medical or mental health advice.

Your use of our content does not create a therapist-client, physician-patient, coach-client, or other professional healthcare relationship.

Always consult an appropriately qualified professional regarding your individual health, symptoms, medications, diagnosis, treatment, or personal circumstances.

If you are in the United States or its territories and are experiencing emotional distress or thoughts of suicide or self-harm, call or text 988 or visit 988lifeline.org. If you or someone else is in immediate danger, call 911. Outside the United States, contact your local emergency services or crisis resource.

3. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase our offerings or create an account.

By using the website or purchasing an offering, you represent that the information you provide is accurate, current, and complete.

4. PERSONAL RESPONSIBILITY

You are responsible for deciding whether our content and offerings are appropriate for you.

You understand that personal development may involve emotional reflection and that each person’s circumstances, needs, experiences, and results are different.

You agree to use reasonable judgment when applying information and to seek qualified professional assistance when appropriate.

You remain responsible for your decisions, actions, safety, health, and well-being.

5. PURCHASES AND PAYMENT

Prices, payment options, included materials, access terms, and other purchase details will be presented on the applicable sales, registration, or checkout page.

By submitting payment information, you:

  • Authorize the applicable payment processor to charge the stated amount;

  • Confirm that you are authorized to use the selected payment method;

  • Agree to provide accurate billing information; and

  • Agree to pay all applicable charges associated with your purchase.

Prices may change at any time. A price change will not alter a purchase that has already been completed unless you agree otherwise.

You are responsible for any applicable taxes, fees, currency-conversion charges, or other costs imposed by your financial institution or jurisdiction.

We may use third-party payment processors. We do not directly store or control all payment information supplied to those providers, and your use of their services may also be governed by their terms and privacy policies.

6. PAYMENT PLANS

When a payment plan is offered, it divides the full purchase price into installments. It is not a month-to-month subscription and does not allow you to stop paying simply because you stop participating, using the materials, or accessing the program.

By selecting a payment plan, you authorize the scheduled charges disclosed at checkout and agree to pay the entire purchase price.

If a scheduled payment fails, we may:

  • Notify you and request updated payment information;

  • Retry the payment as permitted by the payment processor;

  • Suspend access to the applicable offering or community; and

  • Restore access after the account is brought current.

Ending your participation or losing access because of nonpayment does not automatically cancel the remaining balance.

Nothing in this section limits any nonwaivable rights available to you under applicable law.

7. REFUNDS, CANCELLATIONS, AND TRANSFERS

Refund, cancellation, transfer, and rescheduling terms may vary by offering. The policy stated on the applicable sales, registration, or checkout page is incorporated into these Terms and controls for that purchase.

Please review the applicable policy before completing your purchase.

Unless a different policy is expressly stated at the time of purchase:

  • Purchases of immediately accessible digital downloads, recordings, workbooks, templates, and self-paced course materials are final and nonrefundable once delivered or accessed;

  • Failure to download, open, attend, complete, or use an offering does not automatically create a right to a refund;

  • Change of mind, scheduling conflicts, technology limitations, or dissatisfaction based solely on personal preference do not automatically qualify a purchase for a refund; and

  • Access may not be transferred, shared, assigned, or resold without our written permission.

Live events, retreats, workshops, and experiences may have separate refund, transfer, cancellation, and material-shipping policies. Those terms will be displayed on the applicable registration page.

If we cancel an offering without providing a reasonable replacement, rescheduled date, or comparable alternative, we will explain the options available to affected purchasers.

Nothing in these Terms eliminates any refund, cancellation, or consumer-protection right that cannot legally be waived.

8. DIGITAL PRODUCTS AND PROGRAM ACCESS

When you purchase or receive a digital product or program, you receive a limited, personal, revocable, nonexclusive, nontransferable license to use it for your own individual educational purposes.

You do not receive ownership of the content or intellectual property.

Access instructions may be delivered by email or provided through a third-party platform. You are responsible for:

  • Providing a working email address;

  • Checking spam, promotions, and junk folders;

  • Maintaining the security of your login information;

  • Using compatible technology and internet access; and

  • Contacting us within a reasonable time if access information does not arrive.

We may update, improve, reorganize, or replace materials as an offering evolves, provided that the overall nature of the purchased offering is not materially misrepresented.

9. MEANING OF “LIFETIME ACCESS”

When an offering includes “lifetime access,” this means access for the operational life of that offering while we continue to own, operate, and make it available.

It does not mean the lifetime of the purchaser, Tracy Lynn Gray, the Company, or any particular third-party platform.

Technology, hosting services, laws, licensing requirements, and business circumstances can change. If an offering with lifetime access must be permanently discontinued, we will make reasonable efforts to provide advance notice and an opportunity to download eligible materials when doing so is technically and legally possible.

Community access described as lifetime access remains available for as long as we continue operating the applicable community.

10. LIVE WORKSHOPS, RETREATS, AND EVENTS

Dates, times, time zones, formats, locations, accessibility information, materials, recording availability, and participation requirements will be stated on the applicable registration page.

Unless otherwise stated, event times are listed in Eastern Time.

We may make reasonable changes to an event’s schedule, platform, presenter, format, curriculum, or included materials when necessary.

Some events may be recorded. Others may not be recorded to protect participant privacy. Recording and replay information will be disclosed on the applicable registration page.

Personal conversations, participant contributions, and breakout-room discussions may be excluded from recordings even when the primary presentation is recorded.

You may not record, photograph, screenshot, reproduce, livestream, distribute, or publish an event or another participant’s contribution without express permission.

Participation is voluntary. You will not be required to disclose personal information, turn on your camera, or speak publicly unless a particular experience clearly states otherwise before registration.

Please contact us before an event if you need captions, scheduled breaks, materials in an alternative format, or another accommodation. We will make reasonable efforts to understand your needs and explain what can be provided, but we cannot guarantee that every requested accommodation will be available.

We may remove a participant whose behavior is disruptive, threatening, harassing, discriminatory, unsafe, or harmful to other participants. Removal for a serious conduct violation may occur without a refund.

11. MAILED MATERIALS AND OPTIONAL UPGRADES

Some events or offerings may include mailed materials, physical products, or optional upgrades.

Shipping availability, deadlines, eligible locations, additional costs, and estimated delivery information will be disclosed before purchase when applicable.

You are responsible for providing an accurate and complete delivery address by the stated deadline.

We are not responsible for delays caused by carriers, customs, incorrect addresses, weather, or circumstances outside our reasonable control.

Any replacement or reshipment options will be determined based on the circumstances and the policy stated for that offering.

12. PRIVATE WORKSHOPS, SPEAKING, AND ORGANIZATIONAL SERVICES

Private workshops, speaking presentations, consulting arrangements, and services provided to organizations may be governed by a separate written agreement.

If a separate signed agreement conflicts with these Terms, the separate agreement will control for that engagement.

Submitting an inquiry does not reserve a date or create a binding engagement. A booking becomes confirmed only after the required agreement has been signed and any required payment or deposit has been received.

13. COMMUNITY ACCESS AND PARTICIPANT CONDUCT

Certain offerings may include access to a private community, including the Alpha Pack™ or another discussion space.

These communities are educational and supportive spaces. They are not therapy groups, crisis services, medical forums, or sources of emergency assistance.

Community access does not include a promise of individual coaching, private advice, ongoing personal responses from Tracy, or a particular level of participation by any member.

You agree not to:

  • Harass, threaten, shame, intimidate, or discriminate against another person;

  • Post crisis, suicide, self-harm, or emergency content requiring immediate professional intervention;

  • Provide medical diagnoses or direct another member to begin, stop, or change treatment or medication;

  • Share another person’s private information or community contributions outside the community;

  • Solicit members, promote unrelated products, or send unsolicited private messages;

  • Upload unlawful, defamatory, infringing, deceptive, or harmful material;

  • Impersonate another person;

  • Share your login or allow another person to access paid content through your account; or

  • Disrupt the community or interfere with another participant’s experience.

We may moderate, remove, or decline to publish content. We may suspend or terminate community access when we reasonably believe these Terms or the applicable community rules have been violated.

Because community spaces involve other participants, we cannot guarantee that every participant will preserve confidentiality. Please use discretion and do not share information you would not want repeated outside the community.

14. INTELLECTUAL PROPERTY

All original content provided through this website or our offerings—including text, videos, audio, recordings, presentations, course materials, frameworks, methods, workbooks, worksheets, journals, templates, downloads, graphics, logos, photographs, designs, brand names, and trademarks—is owned by or licensed to Alpha with Tracy Lynn Gray LLC unless otherwise stated.

This includes, without limitation, The A.L.P.H.A. Method™, The Anxious Alpha™, The ADHD Alpha™, Alpha with Tracy Lynn Gray™, the Alpha Pack™, and the titles and contents of our original products and programs.

Except where we provide written permission, you may not:

  • Copy or reproduce our content;

  • Share purchased or subscriber-only materials with another person;

  • Upload materials to shared drives, membership libraries, course platforms, social media, or file-sharing services;

  • Sell, license, sublicense, or distribute our content;

  • Modify our materials and present them as your own;

  • Teach, facilitate, perform, or deliver our proprietary materials to others;

  • Use our materials to create competing products or derivative works;

  • Remove copyright, trademark, or ownership notices;

  • Upload our protected materials into generative artificial-intelligence systems, datasets, or model-training systems; or

  • Use our content for commercial purposes without a separate written license.

You may share a public link to our website or publicly available content, provided that you do not misrepresent the source, copy the entire work, or imply endorsement or affiliation.

Brief quotations may be used when permitted by law and accompanied by appropriate attribution.

15. USER-SUBMITTED CONTENT

If you voluntarily submit a testimonial, review, comment, photograph, question, success story, or other content, you represent that:

  • You created it or have permission to share it;

  • It is truthful to the best of your knowledge;

  • It does not violate another person’s rights; and

  • It does not contain unlawful or intentionally harmful material.

We will request permission before using private feedback or a nonpublic communication as an identifiable marketing testimonial.

When you authorize us to use submitted content, you grant us a nonexclusive, worldwide, royalty-free license to reproduce, edit for length or clarity without changing its meaning, display, and publish it for the purposes described in that authorization.

16. TESTIMONIALS AND INDIVIDUAL RESULTS

Testimonials, reviews, case examples, and participant stories describe individual experiences.

They are not promises, guarantees, or representations that you will achieve the same outcome.

Personal development, anxiety management, behavior change, productivity, confidence, and self-leadership are highly individual. Results depend on many factors, including personal circumstances, participation, implementation, health, support, and factors outside our control.

We do not guarantee any particular personal, emotional, professional, financial, medical, or therapeutic result.

17. EMAILS AND COMMUNICATIONS

When you request a resource, register for an event, make a purchase, or subscribe to our emails, you agree to receive messages related to that request or transaction.

If you expressly consent to marketing emails, you may also receive newsletters, educational content, announcements, and promotional messages. You may unsubscribe from marketing emails at any time by using the unsubscribe link included in those messages.

You may still receive necessary transactional or account-related communications after unsubscribing from marketing emails.

You are responsible for ensuring that your email address remains accurate and accessible.

18. THIRD-PARTY SERVICES AND LINKS

Our website and offerings may use or link to services operated by third parties, including website hosts, email providers, payment processors, course platforms, community platforms, video services, social-media platforms, file-storage providers, and external websites.

We do not own or control those third parties and are not responsible for their availability, security, content, terms, privacy practices, or actions.

A link to a third-party resource does not necessarily mean that we endorse, sponsor, or guarantee it.

Your use of a third-party platform may be governed by that provider’s separate terms and policies.

19. WEBSITE AND SERVICE AVAILABILITY

We work to keep the website and our offerings reasonably available, but uninterrupted access cannot be guaranteed.

Access may be temporarily or permanently affected by:

  • Maintenance or updates;

  • Internet or hosting interruptions;

  • Third-party platform changes;

  • Security concerns;

  • Equipment or software failures;

  • Legal or regulatory requirements;

  • Natural disasters, illness, emergencies, or other circumstances outside our reasonable control.

We are not responsible for temporary interruptions that are outside our reasonable control.

20. PROHIBITED USE

You may not use this website or our offerings to:

  • Violate any applicable law;

  • Infringe intellectual-property or privacy rights;

  • Transmit malware, malicious code, or harmful material;

  • Attempt unauthorized access to an account or system;

  • Scrape, harvest, or collect information without permission;

  • Circumvent access, payment, or security controls;

  • Misrepresent your identity or affiliation;

  • Interfere with the website or another person’s use of it; or

  • Engage in fraudulent, abusive, or deceptive conduct.

21. SUSPENSION AND TERMINATION

We may suspend or terminate access to the website, a product, program, event, account, or community when we reasonably believe that you have:

  • Failed to make a required payment;

  • Shared an account or protected materials;

  • Violated intellectual-property rights;

  • Engaged in harassment, threats, discrimination, or unsafe behavior;

  • Used an offering unlawfully;

  • Attempted to compromise the security or operation of a service; or

  • Materially violated these Terms.

When appropriate, we may provide notice and an opportunity to correct the issue. Serious, unlawful, unsafe, or repeated violations may result in immediate termination.

Termination for a violation does not automatically entitle you to a refund or eliminate an unpaid contractual balance, subject to applicable law.

22. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website and our content and offerings are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The website or an offering will always be uninterrupted or error-free;

  • Every tool or strategy will be appropriate or effective for every person;

  • All information will remain current or complete;

  • A particular platform, feature, or format will remain available; or

  • Participation will produce a particular outcome.

Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

23. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Alpha with Tracy Lynn Gray LLC and its owners, employees, contractors, representatives, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of—or inability to use—the website, content, products, programs, communities, workshops, events, or services.

To the fullest extent permitted by law, our total liability arising from a particular paid offering will not exceed the amount you paid directly to us for that offering.

For free content or resources, our total liability will not exceed one hundred U.S. dollars.

These limitations do not apply where liability cannot legally be limited or excluded.

24. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Alpha with Tracy Lynn Gray LLC and its owners, employees, contractors, representatives, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your unlawful use of the website or an offering;

  • Your violation of these Terms;

  • Your infringement of another person’s rights; or

  • Content you submit or distribute.

This section does not require you to indemnify us for conduct for which indemnification cannot legally be required.

25. FORCE MAJEURE

We will not be responsible for a delay, interruption, cancellation, or failure caused by circumstances beyond our reasonable control.

These circumstances may include severe weather, natural disasters, power or internet outages, platform failures, illness, emergencies, labor disruptions, government action, war, terrorism, civil unrest, epidemics, pandemics, or similar events.

When possible, we will communicate material changes and provide reasonable alternatives based on the circumstances.

26. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy.

By using the website or our offerings, you acknowledge that you have had an opportunity to review the Privacy Policy.

27. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Before filing a legal claim, you agree to contact us at support@theanxiousalpha.com and make a good-faith effort to resolve the dispute informally.

If the dispute is not resolved, any legal proceeding shall be brought in a court of competent jurisdiction located in the City of Virginia Beach, Virginia, unless applicable law requires otherwise.

Nothing in this section prevents either party from seeking appropriate relief for intellectual-property infringement, unauthorized access, fraud, threats, harassment, or another matter requiring immediate action.

28. CHANGES TO THESE TERMS

We may update these Terms when our business, offerings, technology, or legal obligations change.

The revised Terms will be posted on this page with an updated effective date.

Changes apply prospectively from the stated effective date. Your continued use of the website or our offerings after the updated Terms become effective constitutes acceptance of the revised Terms.

Material changes affecting an existing paid purchase will not retroactively remove rights expressly granted at the time of purchase unless required by law or accepted by you.

29. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

The unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable when permitted by law.

30. NO WAIVER

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of the Company.

31. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our written permission.

We may assign these Terms as part of a merger, sale, restructuring, transfer of assets, or other lawful business transition.

32. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Disclaimer, applicable sales-page terms, checkout disclosures, community guidelines, and any separate written agreement, constitute the agreement governing your use or purchase.

If a signed agreement or specific offering policy conflicts with these general Terms, the more specific agreement or policy will control for that offering.
